Cook Country Judge rules law banning recording police to be unconstitutional

A man was arrested by police for selling art on the side of the road, and when it was discovered that he had a recording device, the arrest had a Class 1 felony attached to it for illegally recording the police.

The judge threw out the law as being over-broad, and that innocent infringers could be prosecuted. One example was a parent video recording a child's soccer game would pick up side conversations.

Well, overbroad still gets the right effect. Too bad it's not really the right reason, and that a retuned law of that nature could still be used against people.
