I don't think it's an issue, it's pretty standard for games to have licensing agreements allowing for mods to be made, as long as you're not copying and distributing their code. They frequently supply you with code and tools for doing such, though I can't name any games off hand that do that. This amounts to tons of free advertising, plus all the people who say "I can write better scripts than that!" who try and improve on the product.
I think it's a heck of a cottage industry, so to speak, and now that RoosterTeeth has shown the way that there will be more things like this. The smart ones won't use Halo or Sims2 unless they can make a reamrkably different quality product, but what do I know.
