It could be. It was recently learned that the FBI was able to turn cell phones into bugs during a Mafia investigation. The interesting part is that they were able to record conversations while the phone was apparently turned off.

The judge "...concluded that the 'roving bugs' were legally permitted to capture hundreds of hours of conversations because the FBI had obtained a court order and alternatives probably wouldn't work."

Now, odds are that anyone reading this is probably not the target of an FBI probe that's going to force them to use techniques like this. If the technology is out there, who is to say that it isn't being co-opted? Look at what Hewlett-Packard did with their pretexting and spying case.

Well, conveniently here's a post describing how to recognize some potential symptoms as to whether or not your cell might be bugged.
