Yep. Best Buy and Circuit City are included in the suit for selling violating products.

I really hate the concept of companies that buy patents for the sole purpose of suing people in violation. They have absolutely nothing except attorneys: they don't make things, they don't research new things, they don't invent, they don't contribute, all they do is litigate.

This is sad. I would think that most judges would look at such a case and laugh. So obviously I don't want to get sued in Marshall, Texas.

There are several "choice spots" for filing law suits against big business, and Marshall is one of 'em. The town demographics almost guarantee a win for small challengers, though how you can classify a patent troll with a huge investment in patents as a small company I do not know.

But the thought of suing the retailers is just boggling. They have absolutely no control or information to scrutinize whether or not one of their vendors is violating someone's patent.

Yeah. Unless they could somehow prove in some very convoluted way that the retailers knew their vendors were violating patents and still sold their products anyway. Which would be really silly - why should retailers have to do patent research just to be assured they can legally sell products?
