Apparently, like Disney wanting a trademark on the phrase Dio de los Muertos, Fox wants nothing else to exist that might confuse people.

It would be laughable if it weren't for the fact that to file a DMCA takedown notice that the filer must affirm under penalty of perjury that all the facts are true. Considering that there is no way Doctorow's book could be confused for the TV series, that person committed perjury because they clearly had no clue.

I'm betting 99% of that process was automated and that the quality control just checked to make sure that Homeland was the named title. I hope the judge takes Fox to the cleaners to discourage others from filing frivolous takedowns.

Cory hadn't committed yet to whether or not he's going to sue Fox, it's arguable that they caused him any damage. It would be good to have Fox thoroughly spanked, but I doubt it'll happen this time.

Could anyone served with an erroneous takedown notice sure Fox for something like harassment or some other offense? Arty which point the petty could be tacked on? And enough of them could make for a very public class action trial.
