This will have a major effect on the election cycle. Two candidates, plus the President of the Senate, says Obama shouldn't nominate anyone for the position and if he does, they won't get approved. The process is that the nominee has to pass the Senate Judiciary Committee, then by the full Senate. And they have to have a 60 vote majority.

Date: 2016-02-14 05:57 pm (UTC)But what is likely to happen is the Repubs will stall it for as long as possible, then realize that it makes them look more and more like the obstructionist party as the election draws closer, and then they'll rush to approve someone. Obama will improve his chances of getting someone through if he nominates a more centrist person rather than a hard-core Democrat.
It's a Time Will Tell thing, to see who Obama puts forth, and to see how stupid the Republicans are capable of continuing to be.
