Thank you! This is something that I've been saying for a while, and within the context of individuals who have committed acts of mass murder, they certainly should be tried in NYC.

Definitely. I think Bill'O and his ilk are worried that KSM might go free, possibly because of the torture visited upon him by the previous administration. Thus, they want to be able to control the whole process, which means secret military commissions where the defense has no right to the evidence or the testimony.

Really, though, I don't see this administration putting them up for prosecution if they're not absolutely convinced they'll end up with a conviction.
