I thought this was inevitable, and a guarantee it'll go to the Supreme Court. The interesting thing is that a Bush appointee said it was unconstitutional while a Clinton appointee said it was lawful. Apparently there are some judges who are capable of exercising thought independent of party lines.

Well, now the Supremes get to decide whether the left or the right hand is the correct one. Lovely.

I would expect it to be a more nuanced decision than legal/unconstitutional. I think they'll say some parts are legal, others aren't, much like the Affordable Care Act. We'll see, but probably not until 2015.

Apparently the thing that will trigger a SCOTUS review is if both decisions are upheld on appeal. Amazing stuff.
